1. Data Collection & Automated Processing
We collect Identity Data (name, ID), Contact Data, Financial Data (via Stripe), and Precise Location Data (including background tracking for Drivers). We use automated matching systems to connect Users and Drivers.

We process personal data based on:
- Performance of a Contract: To provide and operate the platform and connect Users with Drivers
- Legitimate Interests: To ensure platform security, prevent fraud, and improve our Services
- Legal Obligations: To comply with tax, regulatory, and legal requirements in the UK
- Consent: Where required, including for certain marketing tracking or communications

3. Data Sharing & Transfers
Data is shared with: (a) Drivers/Users to facilitate orders; (b) Stripe (Payments); (c) Cloud providers (e.g., AWS); (d) Authorities where legally required. Data may be transferred outside the UK/EEA under Standard Contractual Clauses (SCCs).

We retain personal data while the account is active. Upon account closure, transaction records and identity data are kept for three (3) years to satisfy UK tax, legal, and anti-fraud obligations.

Terms and Conditions (Users)

1. The Contractual Relationship
OLVIO TECHNOLOGY LTD ("OLVIO") provides a technology platform connecting Users with independent third-party providers (Drivers). OLVIO IS NOT A TRANSPORTATION CARRIER AND IS NOT A FREIGHT FORWARDER. All logistics and transport services are performed by independent contractors. These Terms constitute the entire agreement between you and OLVIO and supersede all prior agreements, communications, or understandings.
2. Service Provision and Matching
2.1. Automated Matching: OLVIO may use automated systems and algorithms to match Users and Drivers based on location, vehicle type, availability, and other parameters.
2.2. No Guarantees: OLVIO DOES NOT GUARANTEE: (a) the availability of Drivers; (b) the acceptance of any specific request; (c) the quality, suitability, safety, or ability of Drivers; or (d) the successful completion of any transport service.
2.3. Contract of Carriage: When a Driver accepts a request, a direct legal contract is formed between the User and the Driver. OLVIO is not a party to this contract.
2.4. Platform Rights: OLVIO reserves the absolute right to modify, suspend, or discontinue any part of the Services or any User account at its sole discretion without prior notice.
OLVIO may perform basic checks on Drivers; however, OLVIO does not guarantee the authenticity, validity, or legality of any documents or licenses provided by Drivers.
3. User Obligations & Prohibited Conduct
3.1. Accuracy: You must provide accurate, complete, and up-to-date information.
3.2. Prohibited Items: You shall not request transport for: hazardous waste, unlicensed weapons, illegal drugs, stolen property, or items exceeding legal vehicle weight/size limits.
3.3. Special Cargo: For Livestock or Farm Animal transport, the User MUST provide all legally required documentation (e.g., Horse Passports, Health Certificates, Movement Licenses).
3.4. Waste and Scrap Transport: Users and Drivers acknowledge that the transportation of waste materials is subject to UK environmental regulations. Drivers are solely responsible for holding a valid Waste Carrier License and complying with all applicable laws, including Duty of Care obligations under UK law.
4. Pricing and Payments
4.1. Pricing Model: The App provides a suggested estimate. Drivers may offer a lower price (bid) at their discretion. Once you accept a bid, the price is binding.
4.2. Payment Processing: All payments are processed via third-party providers (e.g., Stripe Connect).
4.3. Refunds: OLVIO reserves the absolute right to determine refund eligibility. No refunds are issued for "change of mind", minor delays, or incorrect info provided by the user.
5. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." OLVIO DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY. OLVIO uses reasonable care in providing the platform but does not guarantee uninterrupted or error-free service.
6. Limitation of Liability & Force Majeure
6.1. Liability Cap: OLVIO's total aggregate liability shall not exceed the greater of: (a) fees paid by you to OLVIO in the 3 months preceding the claim; or (b) £100 (one hundred pounds sterling).
6.2. Indirect Damages: OLVIO is not liable for incidental, special, or consequential damages, including loss of profits, data, or injury/death of property or livestock.
6.3. Force Majeure: OLVIO is not liable for delays or failures caused by events beyond its control (weather, strikes, road closures, or technical outages).
7. Dispute Resolution & Indemnity
7.1. Disputes: Users must first contact OLVIO support to resolve any issues. OLVIO acts as a mediator but is not a party to the carriage contract.
7.2. Indemnity: You agree to indemnify and hold OLVIO harmless from all claims, losses, and legal fees arising out of your use of the Services, your breach of these Terms, or your dispute with a Driver.
8. Governing Law
These Terms are governed by the laws of England and Wales. Exclusive jurisdiction: Courts of London.

Driver Services Agreement

1. Independent Contractor Status
The Driver is an independent contractor. No employment relationship is created. The Driver is solely responsible for UK National Insurance, taxes, and VAT obligations.
2. Licensing & Compliance
2.1. Driver must hold a valid UK driving license, vehicle registration (V5C), and "Hire and Reward" insurance.
2.2. For Livestock transport, the Driver warrants compliance with DEFRA (UK) welfare standards.
2.3. Drivers are free to accept or decline requests matched by the platform's automated systems.
2.4. Waste Transport: If the Driver undertakes transport of waste materials, the Driver confirms they hold a valid Waste Carrier License and comply with all environmental regulations and Duty of Care requirements.
3. Liability & Indemnity (Driver)
OLVIO's liability to the Driver is capped at £100. The Driver shall indemnify OLVIO against any claims arising from the Driver's performance, traffic violations, accidents, or cargo damage.
4. Payments (Driver)
Processed via Stripe Connect. OLVIO reserves the right to withhold payouts during active disputes or investigations of service failure.
Refund & Dispute Policy
Cancellation Rules
- Before Driver Acceptance: £0
- After Driver Acceptance/En Route: A fixed Cancellation Fee applies to compensate the Driver
- On-Site Refusal: If cargo is unsafe, illegal, or differs from the description, the platform fee is non-refundable
Dispute Resolution
- Reporting: Users must report damage or issues via the app within 24 hours with photo evidence
- Mediation: OLVIO reviews GPS logs and chat history. We reserve absolute discretion in issuing refunds
- Chargebacks: Fraudulent chargebacks result in permanent account termination. OLVIO's total liability remains capped at £100

What is OLVIO exactly?
OLVIO is a digital marketplace platform. We connect customers with independent drivers. We are not a transport company and do not own vehicles.
Does OLVIO guarantee a driver?
No. We do not guarantee driver availability, that your request will be accepted, or that the service will be completed. Our automated systems work to find the best match, but the final choice to accept rests with the Driver.
Is my cargo insured by the platform?
No. OLVIO does not provide insurance. You must verify if the Driver has adequate "Goods in Transit" insurance or obtain your own coverage for high-value items or livestock.
Does OLVIO guarantee the quality of the service?
No. We provide the technology to connect you, but we do not guarantee the quality, suitability, or ability of the independent Drivers.
How is pricing calculated?
The app provides a suggested estimate. Drivers can bid a lower price to win your order. Once you accept a bid, the price is fixed (excluding unexpected tolls or parking).
Can I transport animals (horses, pets, farm animals)?
Yes, in designated categories. However, you MUST provide all legal permits (e.g., Horse Passports). Drivers must also have the correct certificates for animal transport (DEFRA).
What items are prohibited?
Hazardous waste, illegal drugs, unlicensed weapons, stolen goods, or anything violating UK safety laws.
What happens if I cancel my order?
If a Driver is already driving to you, a cancellation fee will be charged to cover their time and fuel.
What if my goods are damaged?
Report it via the app within 24 hours with photos. OLVIO will act as a mediator to help you resolve the issue with the Driver's insurance.

What is the limit of OLVIO's legal liability?
To keep our service affordable, our total liability is limited to £100 per claim. The primary contract is between you and the Driver.
How do you protect my data?
We are UK GDPR compliant. We track location only for active orders and retain your data for 3 years after account closure for legal and tax safety.
Why can my account be suspended?
We may terminate access for providing false info, harassing drivers, fraudulent chargebacks, or any violation of our Terms.
